Intent to Modify DEP General Permit Herbicides for the Control of Invasive Aquatic Plants Please take notice that, pursuant to Water Pollution Control 38 M.R.S. §§413 and Conditions of licenses, 30 M.R.S. §414-A, and Rules Concerning the Processing of Application and Other Administrative Matters, 06-096 CMR 2, and General Permits for Certain Wastewater Discharges, 06-096 CMR 529, the Maine Department of Environmental Protection (Department) intends to modify General Permit (Waste Discharge License) #MEG150000, Herbicides for the Control of Invasive Aquatic Plants, issued by the DEP on April 3, 2017 “General Permit”). The General Permit covers the entire State of Maine. Coverage under the General Permit authorizes the Department’s Invasive Aquatic Species Program (IASP) and its qualifying agents to discharge aquatic herbicides to Class GPA, AA, A, B, and C waters of the State, tributaries to Class GPA waters, and those waters having drainage areas of less than 10 square miles, when they contain populations of invasive aquatic plants. The proposed modification includes inclusion of the herbicide florpyrauxifen-benzyl for use in the control of aquatic invasive plant species. The Department has not scheduled a public hearing on the proposed draft modification to the General Permit. Persons wishing to request a public hearing or wishing to request that the Board of Environmental Protection (BEP) assume jurisdiction over the modification of the General Permit may do so during the 30-day public comment period. Requests must state the nature of the issues(s) to be raised.
