Notice of New Enforcement Discretion Concerning the 6 NYCRR Parts 370-374, 376 of the Hazardous Waste Management Regulations

DEC recently published two new enforcement direction letters that address the management of waste airbags and amend the P075 hazardous waste listing for nicotine and salts to exclude FDA-approved over-the-counter nicotine replacement therapies.

The Management of Waste Airbags enforcement discretion letter details the proper procedures for managing both defective and non-defective waste airbags in New York State. You can find more information about this enforcement discretion on DEC’s Management of Waste Airbags web page.

The Amendment of the Nicotine Listing enforcement discretion letter describes the changes to the P075 hazardous waste listing for nicotine to exclude over-the-counter nicotine replacement therapies including nicotine gums, patches, and lozenges. It should be noted that other nicotine-containing wastes like e-liquids and manufacturing grade nicotine formulations will continue to be included in the P075 hazardous waste listing for nicotine.
